Terms of Service

Calbank (“Calbank,” “we,” “us,” or “our”) is a calorie and nutrition tracking mobile application operated by Timothy Titenok. “Service” means the Calbank mobile application, the website joincalbank.com, and all related features, content, and services. “You” means the person using the Service.

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 13 years old to use Calbank. If you are between 13 and 17, you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf. Calbank is not directed at children under 13, and we do not knowingly collect data from them.

Calbank is not a medical service and does not provide medical advice, nutrition counseling, or professional health services.

• All calorie counts, macronutrient values, food identifications, and calorie plans generated by the Service, including results produced by AI photo analysis, are automated estimates and may be incomplete or inaccurate.
• The Service is not intended to diagnose, treat, cure, or prevent any disease or condition, including eating disorders.
• Weekly calorie plans are general-purpose calculations based on the information you provide. They are not a substitute for advice from a physician or registered dietitian.
• Do not use Calbank if a medical professional has advised you against calorie restriction or self-directed weight management. If you have or suspect a medical condition, consult a licensed professional before using the Service.

You may create an account using your email address, Sign in with Apple, or Google Sign-In. You agree to provide accurate information, keep your sign-in credentials secure, and notify us of any unauthorized use. You are responsible for activity that occurs under your account.

You may delete your account at any time from within the app (Profile → Delete Account). Deletion is permanent and removes your data as described in our Privacy Policy.

“User Content” means information you submit through the Service, including meal photos, meal and weight logs, and profile details. You retain ownership of your User Content. You grant us a limited, worldwide, royalty-free license to host, process, transmit, and display your User Content solely to operate and provide the Service to you (for example, sending a meal photo to our AI provider to estimate its nutrition). We do not use your meal photos to train AI models, and meal photos are not stored on our servers after analysis.

You represent that you have the rights to any content you submit and agree not to upload unlawful, harmful, or infringing content, or images of other people without their consent.

Calbank’s photo meal analysis uses third-party AI technology. Results are probabilistic estimates, not measurements. AI analysis is subject to a daily fair-use limit per account to prevent abuse; the limit is generous and is designed never to affect normal personal use. We may adjust fair-use limits, AI models, or feature availability at any time.

Most Calbank features require a paid subscription. Subscription plans, pricing, free trials, billing, renewal, and cancellation are described in our Subscription Policy, which is part of these Terms. All purchases are processed by the Apple App Store or Google Play Store, and their terms also apply.

We may offer referral or promotional codes that grant free or discounted access. Codes are non-transferable, have no cash value, may be limited in quantity or duration, and may be revoked if we believe they are being misused.

You agree not to:

• Use the Service unlawfully or in violation of these Terms;
• Upload violent, sexually explicit, or unlawful content, or content intended to manipulate or attack the Service or its AI systems;
• Reverse engineer, decompile, scrape, or copy the Service or its content;
• Circumvent authentication, rate limits, usage quotas, subscription entitlements, or other technical protections;
• Share, resell, or transfer your account or subscription;
• Interfere with the operation of the Service or attempt unauthorized access to our systems or other users’ data.

The Service relies on third-party services (such as app stores, sign-in providers, and food nutrition databases including the USDA FoodData Central and FatSecret). We are not responsible for third-party services, and nutrition database entries may contain errors supplied by their sources.

The Service, including its software, design, branding, and content (excluding your User Content), is owned by us or our licensors and is protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the app on devices you own or control, solely as permitted by these Terms and the applicable app store rules. You may not copy, modify, distribute, sell, or lease any part of the Service.

We may suspend or terminate your access if you violate these Terms, misuse the Service, or create risk or legal exposure for us. You may stop using the Service and delete your account at any time. Sections that by their nature should survive termination (including disclaimers, limitations of liability, and dispute terms) survive.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT NUTRITION ESTIMATES WILL BE ACCURATE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100). WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your User Content, your use of the Service, or your violation of these Terms.

If you downloaded the app from the Apple App Store: these Terms are between you and us, not Apple. Apple has no obligation to provide maintenance or support for the app and is not responsible for any product warranties or claims relating to the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-party list.

These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law rules. You agree to first contact us at calbanksupport@gmail.com to attempt to resolve any dispute informally. Any dispute not resolved informally shall be resolved in the state or federal courts located in Ohio, except where applicable law provides otherwise.

We may update these Terms from time to time. Material changes will be announced through reasonable means, such as an in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
